General

  • Terms and Conditions detailed herewith are the terms and conditions on which Euro Plumbing supply any of the products listed on our website www.europlumbing.co.uk to you. Please read these terms and conditions carefully before ordering any Products from our website. You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions. In all circumstances, the terms and conditions apply unless otherwise mutually agreed in writing by the customer and Euro Plumbing Goods and this to be signed and authorised by the Management of Euro Plumbing. Our representatives, agents, staff or drivers are not authorised to agree to any other conditions or to vary these Conditions.
  • These Conditions supersede any previous conditions entered by the parties [You and Us] orally or in writing and all the past dealing will be superseded to these terms and conditions.
  • These Conditions should also be read with the Privacy Policy, Terms of Use of Website & Cookie Policy and you are required to comply with all the terms and conditions. You becoming a customer is bound to comply with all these terms and conditions

Definitions and Interpretation

  • Goods means all goods sold by Us to You,
  • We/Us/Our/Euro means Euro Plumbing Limited registered in England No. 09897214 at 423 Alexandra Avenue, Harrow, England, HA2 9SE. Vat no. 230 7167 31
  • You/Your means the person, company or other legal entity purchasing the Goods.
  • Cookies are small text files stored on your computer
  • Contract means the contract between Us and You for the sale and purchase of Goods in accordance with these Conditions.
  • Site Materials means all materials on this website including, but without limitation to trademarks, design, product details, description, text, graphics, files, codes, photographs, forms, design layout and the arrangement thereof.
  • In the Site Terms, paragraph headings are used for convenience only. They are not intended to describe the entire content of the paragraphs or have any effect on their interpretation.

Customer Registration

  • Ordering the products are possible through our site only on registering and creating an online account with us.
  • Online registration given to You remains Our property and is not transferable.
  • By placing an order through our site, you warrant that:
  • You are acting in the course of trade, a business or a profession;
  • You are legally capable of entering into binding contracts on behalf of the account holder;
  • You have the necessary authority from the account holder to place an order on our site; and
  • You are at least 18 years old

Customer Status

  • We reserve the right to suspend sale or delivery of goods without any liability in the event that circumstances arise which, in our view, justifies us to do so, these are when the use of our website is not as per the terms and conditions or when the payments were not made on in case of your insolvency or bankruptcy. We reserve the right to reduce, hold or cancel the orders in the event of your insolvency, or in the event that you cease or threaten to cease business or enter into voluntary arrangement or become bankrupt.
  • In the event we suspend sale or delivery or refuse to accept orders placed by You due to one of the events in 4.1 above then without limiting any other rights available to Us, any Goods that have been delivered but not paid for shall become immediately due for payment notwithstanding any previous agreement or arrangement to the contrary. The balance is required to be paid in full with immediate effect.
  • Sole traders are personally liable to make payment for Goods and You hereby guarantee and acknowledge personal liability for payment of the Goods and interest chargeable in accordance with these Conditions and no waiver that might be extended in respect of these Conditions shall affect Your liability hereunder. In the event you become a partnership or limited company then you will still remain personally jointly and/or severally liable for payments. All changes are required to be informed to us as soon as the change happens.
  • Where You are a partnership or a limited company, an individual or individual(s) with authority to bind You will be personally liable to make payment for Goods and interest chargeable in accordance with these Conditions and no waiver that might be extended in respect of these Conditions shall affect Your liability hereunder. Where You are a partnership, these Conditions are binding on all of the partners with joint and several liability and no waiver shall affect their individual liability. You shall be obliged to notify Us in any change in the partners of Your business.
  • Online account without any activity will be suspended after a period of 12 months. If You do not make any purchases during this month period then We may require new references and may carry out credit checks where applicable before You are permitted to purchase Goods from Us. We may (at Our discretion) require you to complete a new customer application form.

Prices

  • Prices displayed are applicable on the date of acceptance of Your order and as set out in your invoice.
  • ‘Price is exclusive of VAT, which will be added at the Check out’.
  • Product prices and delivery charges are liable to change at any time and we reserve the right to alter without notice. We are entitled to make amendments to the price to take into account any increase in our supplier’s prices or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. In this unlikely event, we cannot be held responsible for any inaccuracies at any time.
  • We take reasonable precautions to ensure that goods and services are fairly and accurately described on our website and that they are available at the prices listed. We do not warrant that the Site Materials, including but without limitation to product descriptions, photographs and prices are accurate, complete, reliable, current or error-free. In the event, any errors are noticed, we reserve the right to change the goods, services and price without any prior notice. If we do not process an order for such reason, we will advise you that the order has been cancelled and will either not charge you or will apply credit to the payment type used in the order.

Ordering & Payment

  • Once an account is approved and created, you can place your order.
  • Nothing in these Site Terms or elsewhere on this website constitutes an offer to sell or supply goods or services. Your order of goods constitutes an offer to purchase them. Our Order Confirmation by email confirms the receipt of your order, but does not constitute an acceptance of it. We will confirm such acceptance to you by sending you an e-mail that confirms that the relevant Product has or Products have been dispatched. The contract between us will only be formed when we send you the Dispatch Confirmation.
  • Ordered products may not be available all the time, so in the event other products are available, we will dispatch rest of them. Contract will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may be in your order but not listed in the Dispatch Confirmation.
  • Title to goods that you order will not pass to you until we have received payment in full for the goods concerned and the goods are delivered to you. We reserve our rights to retain the goods, or recover them from you, at any time until you have paid in full. The risk of loss of or damage to goods that you order will pass to you at the same time as title passes.
  • Each order and the Despatch confirmation is a separate contract and You are responsible for ensuring the accuracy of the order submitted and for giving us all the information we need to process the order.
  • We shall be under no liability for any delay or failure to deliver goods or services ordered via this website if the delay or failure is caused by circumstances beyond our reasonable control.
  • We welcome Visa, MasterCard, Maestro credit cards. When you order goods from us, you will need to complete your credit or debit card details.
  • All card payments are subject to authorisation by your card issuer. If your payment is not authorised, or for any other reason we are not able to take payment when we attempt to do so, we will not fulfil your order.

Delivery

  • Deliveries are charged on the basis of products and areas.
  • You must not cancel any order you have placed with us except by giving us reasonable notice in writing. If you fail to do this, your order will not be cancelled and you will be obliged to pay for it.
  • Please note that delivery timetables are best estimates, and may be subject to change as due to seasonality, weather and other non-specified factors and are not of the essence of the contract between Us. Delivery of the Goods shall be completed on the Goods arrival at Your store or your designated premises or when You take possession of the Goods.
    • All Goods should be examined upon delivery at case level prior to being signed for and must be signed for upon delivery/collection. You are expected to retain one copy of the receipt note which You sign.
    • All prices include VAT. For orders containing multiple items, you will be charged one fee based on the collective weight of your order, unless you specifically request specialist delivery arrangements.
    • Our deliveries are usually handled by Royal Mail, UPS or on larger orders, one of our pallet courier partners. Once collected from our dispatch warehouse, all orders are the responsibility of those drivers and staff. We are unfortunately unable to give any special delivery instructions to drivers e.g. leaving products with neighbours or in sheds. Nor are we responsible for any delays the couriers or delivery companies experience. In instances where goods go missing, we have to allow 30 days in order for us to be able to successfully claim from the carrier.
    • When your order arrives at your address, you will be given the opportunity to check and sign for the products. During delivery, we recommend a visual inspection of your order on arrival for any obvious damages, and to ensure that all products ordered are present.
    • Once you receive your items, please do not store them away for later inspection, as if any goods received are damaged, faulty or incomplete, you must notify us within 48 hours of delivery via email or telephone, quoting your order number for reference. Please open each box and check thoroughly for damages. If we are notified within the given time frame, we will then organise a replacement. In any situations in which customers have adhered to terms and conditions, yet have received goods that are incorrectly supplied or damaged in transit, Euro Plumbing will replace goods free of charge. Please note that in some cases, a courier will refuse to collect and we will be unable to organise a collection.
    • Upon signing, responsibility for these products passes on to you, and any risk of damage or loss is assumed by the purchaser. We are not responsible for any goods received or unpacked by anyone other than the purchaser, so please ensure that person is present to check and sign for the goods at the supplied delivery address.
    • Please do not fit any damaged goods, as we will be unable to replace or refund damaged items which have been installed. If you find your goods are damaged, please get in touch with us and we’ll do our best to help.
    • All damaged goods, wherever possible, must be returned in their original packaging. For international buyers, we cannot be responsible for any postage cost if the item is found to be faulty or damaged. In instances of international orders, product guarantees which depend on British manufacturing standards or assume the end user has a British Standard water system are no longer applicable.
    • Please be aware that we cannot be held responsible for any loss or damage incurred due to errors made by the purchaser during checkout, for example entering incorrect address details, so please ensure all information is correct before processing your order.
    • If you fail to take delivery on the date agreed, then we reserve the right to charge for any subsequent deliveries.
    • We advise against booking any installers, or engaging in preparatory work until full receipt and inspection of your goods, and will not be liable for any tradesperson costs, consequential loss or compensation in any way. Delivery timescales are given as estimates in good faith, but cannot be taken as precise or exact information.
    • We will not liable for any plumbers costs, consequential loss or compensation in any way.
    • Our out of stock items may be available for purchase later on, you are required to contact us for an estimated timescale. The dates are estimated by our suppliers, and are subject to change. We will confirm when an item is back in stock via either telephone or email, and then action can be made for your chosen delivery method.
    • If goods are ordered over the weekend or bank holiday, please be aware that the order date is taken as the next available working day for delivery purposes.
    • When goods are collected from Euro Plumbing dispatch warehouse they become the responsibility of the designated courier. We cannot be held responsible for any delay’s that the courier experiences.
    • For standard pallet deliveries, the responsibility of disposing of delivery packaging materials, such as pallets lies with the customer.

Cancellation Rights

  • You have a right to cancel your order before despatch or within 14 days after the date of delivery by sending written notice of cancellation to Euro Plumbing Limited, 423 Alexandra Avenue, Harrow, England, HA2 9SE or emailing us at info@europlumbing.co.uk quoting your order reference number. We will refund you the cost of the unwanted item within 30 days. Once you receive the cancelled order please return the item back to us within seven days of receiving the parcel.
  • This right of cancellation does not apply where Goods are specifically made to your specification or personalised at your request or to traders.
  • After 14 days from the day after the Goods have been received, you will not be able to cancel the Contract.
  • All goods, wherever possible, must be returned unused and in their original packaging. We cannot refund goods that have been damaged whilst in your possession.
  • We are not responsible for any return costs for unwanted items, you will need to arrange for the shipping yourself and ensure their safe return.

Returns Policy

  • In the event that upon delivery You discover damaged Goods, Goods that appear to have been tampered with, shortages or an incorrect delivery, You may return such Goods to Us on the vehicle in which they were delivered or at the store/depot if collected. The annotations or alterations should be noted in the driver’s note (and agreed with Our driver), a copy of which should be retained by You. Upon receipt and checking of returns, we will issue appropriate credit note or refund. Damaged Goods must be returned in their original, unmarked packaging. All boxes, packaging, cages, tanks, pallets must be checked at time of delivery. Damaged Goods and/or short dated Goods or excesses more must be returned with Our driver, if not returned, the excess of Goods will be charged and you must pay Us for such excess. We will not give any credit or refunds for any of those excess Goods.
  • In the event of non-arrival of the Goods or if You learn that they have been lost or destroyed in transit, notice from You of this must be received by Us as set out the relevant clauses here, such notice to be given at the latest the working day after delivery was due.
  • In the event that subsequent to the above You discover any further damaged Goods, Goods that appear to have been tampered with, shortages or an incorrect delivery, You must notify Us by phone within one working day of the delivery, setting out full details of damage, apparent tampering, short or incorrect delivery, by way of product description and code. Credit or Refund will only be considered by Us where these terms are complied with in full. If notification is not received within 1 working day of the delivery then the Goods shall be deemed to have been properly delivered and accepted. Time and manner of the notification are of the essence.
  • We reserve the right to refuse a Refund or Credit Note in respect of any returned Product that has been tampered with or opened or that is custom made or ordered by us specifically at your request.
  • If You fail to take delivery of the Goods on the date and time or then except where such failure or delay is caused by a Force Majeure Event or Our failure to comply with Our obligations under the Contract, We may;
  • Store the Goods until actual delivery and charge You for the reasonable costs (including insurance) of storage; and/or
  • Sell or otherwise dispose of part or all of the Goods and charge You for any shortfall below the price of the Goods plus the amount of all reasonable storage and selling costs
  • Our inability through shortage of stocks or for any other reason to execute delivery wholly or in part. We reserve the right to make reasonable alterations to products and/or packaging as circumstances may demand. We will not be liable for costs, damages, losses or expenses of any nature resulting from part delivery, suspension of delivery, reduction or cancellation of orders.

Product Warranty and Liability

  • Most products available from Euro Plumbing are supplied with a 12 months manufacturer’s warranty, however most manufacturers offer extended warranties on their products and this will be indicated on the product details page.

Property and Risk

  • Title to goods that you order will not pass to you until we have received the payment including delivery charges in full for the goods concerned and the goods are delivered to you. We reserve our rights to retain the goods, or recover them from you, at any time until you have paid in full. The risk of loss of or damage to goods that you order will pass to you at the same time as title passes.
  • Payments if any are due, full legal and equitable title shall remain with Us and You shall hold the Goods as Bailee only. The goods though remain as Our property until paid for, they are at Your risk from the time of delivery and You shall hold the proceeds of any insurance against loss or damage as trustee for Us and We may charge the proceeds of sale of our Goods into any account which you maintain and You must not assign any rights arising from the sale of such Goods without Our consent.
  • If You breach clause 9.2 then We are entitled to compensatory damages and You are required to remedy the breach immediately on Our request.
  • The payment if any is overdue in whole or in part, or upon commencement of any proceedings for insolvency or bankruptcy We may (without prejudice to any of Our other rights) recover or recall the Goods or any of them and We (and Our agents) may enter upon Your premises or any premises where the Goods are stored for such purpose and You hereby grant Us (and Our agents) a licence to enter upon any premises occupied or controlled by You so as to recover or inspect such Goods, title to which has not passed to You (irrespective of whether such Goods can be specified, or attributed to corresponding purchase orders or delivery notes to the value of the amount due and payable.
  • You may not for any indebtedness pledge or in any way charge by way of security (including without limitation fixed and floating charges) any of the Goods which remain Our property. Without prejudice to Our other rights, if You do so, all sums owing by You to Us shall forthwith become due and payable.

Intellectual Property

  • All Site Materials are owned by us and are protected by UK and international copyright, trade mark and other intellectual property laws.
  • Except as stated in the Site Terms, none of the materials and Intellectual Property described in these Site Terms may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording or otherwise, without our prior written permission or the respective intellectual property rights owner.

Warranties and Limitation of Liability

  • This website, the contents and the materials provided on it are provided with the best of the ability and is on an “as is” and “as available” basis and, to the extent permitted by applicable law, without warranties of any kind, either express or implied.
  • We disclaim to the extent permitted by applicable law, all warranties, conditions and terms express or implied, including, but not limited to, any warranties that might be implied as to the compatibility of the website with your computer equipment, personal devices, software or telecommunications links, or as to the fitness for any particular purpose of the website or the content on the website.
  • We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.
  • Whilst we endeavour to ensure that the information contained in the Website is accurate, we cannot guarantee that the products and services featured in the website will be available all the time. Please note that offers mentioned in the Website may be subject to specific conditions and limitation periods.
  • Reference to any products, services, processes, or other information, by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by Us
  • We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Conditions for:

  • any loss of goodwill or reputation; or

  • Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.
  • You shall indemnify Us in full for all liability, loss, damages, costs and expenses (including legal expenses) awarded against or incurred by or paid by Us as a result of or in connection with any breach or non-compliance with any of the terms of these Conditions.

Privacy Policy

  • All the Personal Information will be treated as confidential, although we reserve the right to disclose this information in the circumstances set out below. We will fully comply with all applicable UK Data Protection from time to time in place.
  • When you shop on this Website, we will ask you to input and will collect Personal Information from you such as your name, e-mail address, billing address, delivery address, telephone number, product selections, credit card or other payment information and a password.
  • We may also collect, and our third party providers of advertisements and content may collect, information about where you are on the internet, your browser type, the country and telephone area code where your computer is located, the pages of our website that were viewed during your visit, the advertisements you clicked on, and any search terms that you entered on our website (“User Information”).
  • We may collect this information even if you do not register with us.
  • You should be aware that this site is being monitored and may capture information about your visit that will help us improve the quality of our service, or be used to present you with Euro Plumbing products which are relevant to your browsing history when you visit other websites.
  • We confirm that any Personal Information which you provide to us (or which is available on public registers) and any User Information from which we can identify you, is held in accordance with the registration we have with the Data Commissioner’s Office. We use your information only for the following purposes:
  • To administer this website and processing your orders;
  • To share the information we hold about you with any group company, any Drop Shipment supplier or any other contractor or third party required for the fulfilment of Our Contract with You;
  • To contact you by post, email, telephone, text or fax with information about goods and services that we feel may be of interest to You that are similar to those you have already purchased;
  • To serve website content and advertisements to you.
  • We will not share or disclose your personal data with any third party without your consent (accept for the limited circumstances) as set out in this Privacy Policy.

Force Majeure

  • We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control.
  • Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
  • Strikes, lock-outs or other industrial action;
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
  • Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
  • Impossibility of the use of public or private telecommunications networks; and
  • the acts, decrees, legislation, regulations or restrictions of any government.
  • Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

Termination

  • These Site Terms shall be governed by and construed in accordance with the laws of England and Wales. Regardless of where you access this website, you agree that any claim or other legal action in law or in equity arising out of or relating to the Site Terms shall be determined only in the courts of England and Wales, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction and venue of such courts over any suit, action or proceeding arising out of the Site Terms.

Security

  • We realise that the internet is based on trust so we make security our number one priority. Our commitment to this will remain prominent for the future. Your credit card details are sent to the banks secure servers whilst the order is processed. No card data is saved and is not visible by any member of staff. At no point are your credit card details sent over using an unsecured connection. Although some customers may be eligible to receive remarketing messages based on their browsing activity, this is intended to help those customers find the products they want easier. These emails are sent via a cookie-based opt-in system by a third party, we do not collect or store any email addresses. If you receive any emails you are not interested in receiving, please click ‘unsubscribe’.

Severability and Waivers

  • The Contract constitutes the entire agreement between Us and You. You acknowledge that You have not relied on any statement, promise, representation, assurance or warranty made or given by or on behalf of Us which is not set out in a Contract.
  • If any provision of these Conditions is held by any court to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions or the remainder of the provision in question shall not be affected.
  • No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any and all provisions documented within the Site Terms. All waivers shall be made in writing

Law and Jurisdiction

  • These Site Terms shall be governed by and construed in accordance with the laws of England and Wales.
